Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “User”, “you”) and Vintech Technologies SAC., dba Revscale (“Revscale”, “Company”, “we”, “us”, or “our”), governing your access to and use of getrevscale.io and any related applications, software, APIs, and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Nature of the Service

Revscale is a subscription-based Software-as-a-Service (SaaS) platform designed to assist businesses in automating revenue recovery workflows and customer lifecycle communications related to billing and subscription events.

The Service integrates with third-party payment processors, subscription management platforms, and billing systems (collectively, “Payment Providers”). Such Payment Providers may include Stripe or other similar platforms. The list of integrations may evolve over time at the Company’s discretion.

Revscale does not process payments, does not hold or transfer customer funds, does not act as a financial intermediary, and does not replace any Payment Provider. All financial transactions remain solely between the Customer and its selected Payment Provider.

2. Eligibility and Authority

You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into binding agreements. If you register or use the Service on behalf of a legal entity, you further represent and warrant that you are authorized to bind such entity to these Terms.

You agree to provide accurate, complete, and current information during registration and to maintain the security and confidentiality of your account credentials. You are solely responsible for all activities conducted through your account.

3. Subscription, Fees, and Billing

Access to the Service requires payment of subscription fees as described on the Revscale website or agreed in writing. Fees are billed in advance and are due in accordance with the selected billing cycle.

Subscriptions automatically renew at the end of each billing period unless cancelled prior to renewal. By subscribing, you authorize Revscale to charge your designated payment method for recurring fees.

All fees are non-refundable except where explicitly required by applicable law. The Company reserves the right to modify pricing upon prior notice, which shall not affect the current billing cycle but will apply to subsequent renewals.

4. Integration with Payment Providers

In order to provide the Service, Revscale may require authorized API access to your selected Payment Provider. By connecting such accounts, you expressly authorize Revscale to access relevant account data necessary to operate the Service, including subscription status, billing events, and customer contact information strictly required to trigger automated workflows.

Revscale does not access banking credentials, initiate payouts, alter financial configurations without authorization, or store login passwords for third-party platforms.

Your relationship with each Payment Provider remains subject to that provider’s own terms and policies. Revscale shall not be responsible for interruptions, API changes, enforcement actions, account suspensions, policy updates, or other operational decisions taken by any Payment Provider.

5. Acceptable Use

You agree to use the Service exclusively for lawful business purposes related to customer lifecycle management, subscription communications, and revenue recovery activities.

You shall not use the Service to send unsolicited bulk communications, engage in spam practices, transmit unlawful or misleading content, infringe intellectual property rights, violate data protection laws, or otherwise engage in conduct that could harm recipients, third parties, or the integrity of the Service.

You remain solely responsible for compliance with all applicable laws, including but not limited to data protection, consumer protection, and anti-spam regulations in the jurisdictions where you operate.

6. Data Protection and Roles

In connection with personal data processed through the Service, you act as the data controller and Revscale acts as a data processor.

You are responsible for establishing a lawful basis for processing personal data, providing appropriate privacy notices, obtaining necessary consents, and handling data subject rights requests.

Revscale processes personal data solely in accordance with your documented instructions as necessary to provide the Service and implements reasonable technical and organizational measures designed to protect such data. Revscale does not sell or commercially exploit customer data.

7. Intellectual Property

All rights, title, and interest in and to the Service, including all software, source code, algorithms, documentation, visual interfaces, trademarks, and proprietary technology, remain the exclusive property of Vintech Technologies S.A.C. or its licensors.

Subject to your compliance with these Terms, Revscale grants you a limited, non-exclusive, non-transferable license to access and use the Service during an active subscription term.

You retain ownership of the data and content you upload to the Service. You grant Revscale a limited license to host, process, and display such data solely for the purpose of providing the Service.

8. Service Availability

The Service is provided on an “as available” basis. While Revscale aims to maintain reliable availability, it does not warrant that the Service will be uninterrupted, error-free, secure, or compatible with all third-party systems at all times.

The Company reserves the right to modify, suspend, or discontinue features, integrations, or components of the Service at its discretion.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Revscale does not guarantee revenue recovery outcomes, deliverability rates, reduction in churn, compatibility with specific Payment Providers, or any particular financial performance.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Revscale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunities, even if advised of the possibility of such damages.

The Company’s total aggregate liability arising out of or relating to the Service shall not exceed the total amount paid by you to Revscale during the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Vintech Technologies S.A.C., its directors, officers, employees, and affiliates from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Service, your communications with end customers, your violation of applicable laws, or your breach of these Terms.

12. Termination

Either party may terminate the subscription in accordance with the billing terms. The Company may suspend or terminate access immediately in the event of material breach, unlawful conduct, or non-payment.

Upon termination, access to the Service will cease. Revscale may delete account data after a reasonable retention period, subject to legal requirements.

13. Miscellaneous

These Terms constitute the entire agreement between the parties regarding the Service. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect. The failure to enforce any right shall not constitute a waiver. Neither party is liable for delays caused by circumstances beyond reasonable control.
